If you maintain a 2 second gap, noone will accuse you of tailgating. When I see someone tailgating me, I'd estimate they're about 20m away or less at 70mph which is less than a half second gap. If I had to brake suddenly, they wouldn't even realise before they hit me.I routinely see people leaving more like a 5m gap, too.
