I just bought my third rental and needed a quick answer from a real estate attorney about filing deeds, so I went to Avvo (great site) and got one. While I was there I started browsing 'related' questions and found HEAPS of tenants asking about landlords entering with no notice and what remedies they had. Wait, what?

Maybe I'm not cut out to be a landlord, but I can't understand why any landlord would enter without notice. First, it's f---ing illegal. Most states have notification requirements like 24 hours - it doesn't matter what the lease agreement says - it can't supercede the LAW.

Second, forget the law... How about some damn respect? My tenants work their asses off to pay ME for the privilege to enjoy their home in privacy. Yes, I'm technically the owner, but the whole f---ing reason they pay me probably 1/4 of the money they bring in (maybe more) is so they have a home they can feel secure in. That is literally what they're paying for! If I don't respect THAT, how can I expect them to respect my property?

Ugh. To all you poor bastards out there with terrible landlords, I'm sorry. If you ever rent from me I may not unclog that pipe until tomorrow, but the least I can promise is that I'll respect your rights.

(PS - I know someone's going to say landlords can enter in emergencies. Yes, of course, if the house is on fire and I happen to be standing next to it I will definitely enter - but mostly to make sure nobody is inside dying. Other than fire, there are very few TRUE emergencies that don't warrant at least a knock and a polite request to enter.)

I always give notice and ask tenant's approval unless in an emergency. It's the legal way and the most respectful.
