How much photoshop was involved?
My tomatoes cause nuclear explosions in women all the time.
No way it's going to kill 400+ people, which is what you expect from a plane crash.

Probably thought it was a friend with an iphone that did that. Low res image posted on facebook. No communication from the photographer.

The laws are only relevant when they are enforced. Go ahead and prove in court that it wasn't fair use. It's innocent until proven guilty.
