Kirby started as a placeholder for the character Popopo. Over time it grew on the team and the Kirby we know became the character.
Artists love it. Takes workload off their hands. It's leads and directors that hate the lack of control.
Plus stuntmen are usually extremely padded for stuff like this. With all the armor on, they have plenty of room to stuff him with pillows.
I believe it would have to state specifically in the contract that you give ownership of your creations to the employer. Not by default.
