This is why the distracted driving charge (or lack thereof) matters.
Everything I was able to find says 2nd degree veh homicide is a misdemeanor here. That's what I'm angry about.
All good, I'm not sure how many states have varying degrees for veh homicide, so it's complicated.
Everything I'm seeing shows that's for 1st degree, not 2nd degree. If you have a different source I will happily get off my soap box.
I just found that as well, you're right. 1 year or $1,000 fine if convicted. Plus a misdemeanor does not prevent him from keeping his job.
If they don't charge him with distracted driving my understanding is it will be considered a misdemeanor.
He will be charged with a misdemeanor, which here means 1 year max in jail or 1000 fine. Anyone else in his situation would be facing 15 yrs
