I think the employer just needs to prove that they could have earned enough via tips to pay them the lower rate.
Been told to do this a lot. Recently tried to research all the candidates. Not easy. Nobody tells you what they actually think.

It could be a Windows Defender thing. I had a similar issue with a new hard drive and disabling Defender solved it (obviously replace it).
When the advice includes "Get advice" you know you're in trouble.
I don't understand what change would come of this then.
Assuming people would read the terms even if they were easier to understand, sure. I am in favor of it even if I doubt people would change.
