Yeah, but generally they can't force an HOA into an existing area. For example, I own my home. If they started an HOA up around me, I can't be forced to join, nor can they make me force a buyer to join when I sell. Supposedly there's a thing where an HOA encumbered home can be inherited without forcing it to be in the HOA but I don't know the real story on that.
