If a state (like TX, where I live) can say "we can throw out write-in candidates if they didn't pay to be on the ballot" then I'd say a state can throw out a candidate b/c they feel like he wouldn't be a good president due to past issues. I don't think Supreme Court can tell the state what to do here.

Hey, republicans voted to not impeach Trump the 2nd time around saying the states should figure it out. Now the states are figuring it out.. but you're not happy with that? They also said the states should figure out abortion rights, and when the states decide "we'll let women get abortions", suddenly folks want to kick it up to fed again. If Fed gov doesn't weigh in, then things fall to the state. Feds should have weighed in much earlier saying if 14th amendment held teeth or not. This "oh, you decided for yourselves? Ok, well, I'll weigh in now if I *have* to" bullshit is getting old fast. If US Supreme Court decides to go against Colorado, they'll basically be saying the 14th amendment has no teeth.

The Colorado Supreme Court however, suspended its decision until January 4, the deadline for the certification of primary ballots in Colorado, in case of appeal to the Supreme Court of the United States before then.“If an appeal is filed with the Supreme Court before this stay expires, it will remain in effect and the election official must still include President Trump's name on the 2024 primary ballot until she receives any injunction or mandate of the Supreme Court” according to this decision

So because some states have ruled that he is eligible and now another state has said he isn't, it is almost certainly going to go to the Supreme Court and whatever they decide will be binding on all the states. So, good news, if SCOTUS days he's intelligible he's done. Bad news, if they say he's eligible it doesn't matter what the state courts say about it.

I legitimately didn't think any state would actually be able to make a convincing enough legal case for that to work (even if we all know that from a common-sense standpoint he shouldn't be allowed to run). Well done, Colorado. Now, we'll have to see how this pans out over this ruling's inevitable journey up to the SC, but I am honestly surprised (and impressed) here.

If I read correctly the lower court didn't rule he couldn't run not because of the inciting an insurrection but because they said he wasn't an "officer" of the US. this court ruled he was and officer of the US so it applied to him. I really want to look up what is considered an "officer of the US" but going through what im assuming is a lot of case law and having no idea where to start is a daunting prospect
