If he gets anything besides nullification by the jury, or hung jury, it will be a shame.

Death penalty?? ? Oh right I forgot it's wasn't happening in a developped country

So why is he in jail?

I hope he’s found not guilty over some random technicality. That’s all I can hope for realistically. Outside of this, they’re trying to crucify him.

Doesn’t the sentence usually come after the verdict?

1 month ago | Likes 6 Dislikes 1

They didn't sentence him yet from what this post is saying, I think it's common for them to figure out the maximum punishment someone could be facing before the verdict

The State gets to decide what punishment it's going to try for, this just means they won't be allowed to try for the death penalty.

His eyes.

Thank you. So, reading that, I understand he still faces the stalking charge.

What are they going to do, issue a restraining order?

He could stalk me.

1 month ago | Likes 1 Dislikes 1

Right, but the death penalty isn't on the table for stalking.

This is a very misleading post. The judge dismissed the murder charge because it was "incompatible legally with stalking" which is just some weird legal BS. Also, and this is important, even if this whole thing is nullified he will be re-tried in NY for murder. That might be why this was dismissed btw, to set him up for a more like death penalty conviction with less chance of pardon or hung jury/nullification. Remember this a federal judge who reports to the crooked Supreme Court.

its not. If you read the article it says he isnt getting death sentence becasue doesn't fit. Even if hes guilty of murder its maximum of life in prison w/o parole.

Did you read the article? Direct quote: "Mangione still faces New York state murder case" The judge's move is also openly political and she cites that openly as a reaction to the actions by the Doj and Bondi. Dont hold your breath on no death penalty.

....yes & that doesn't carry death penalty :| A murder of single person w/o any damage or threat to anyone else would be maximum of lfie in prison. Death penalty is a thing you'd see for mass murders.

NY has not executed someone since 1961 but there are a bunch for single murders prior. Also many other states still do, like Texas, so I'm unsure of your confidence. I did not check the NY statue first. I absolutely stand by the comment that this is a legal game that is political the judge is playing. They are saying so pretty openly. Hope you are right in brushing your hands together and saying this is done. I would love to be wrong

"In 2004, that statute was declared unconstitutional by the New York Court of Appeals, and in 2007 the last remaining death sentence was reduced to life, leaving New York with a vacant death row and no viable death penalty laws."
So yeah..he is NOT getting killed. Worst case is life in prison as thats as bad as NY goes now-a-days.
