The sex offender list doesn't make much sense. If they were put on a list,it would need to be some sort of slander or false accusations list

The penalties obviously shouldn't be applied if there's just not enough evidence. They should be applied if the rape claim is proven false.

Don't be, it's mostly an urban legend, The false report rate for rape is no higher than other crimes, and the conviction rate is super low.
