The story used to be told that this soldier was shot for helping the child. Don't know if its true, but it wouldn't surprise me.

The DDR was no fun at all. Idk about that case but there were soldiers getting shot/punished for helping to flee east Germany.

Soldiers, under the GC, are required to disobey all unlawful orders.

The definition of unlawful is based on the Moral of the soldier. If he thinks its not morally correct he is allowed to disobey it.

Well, under article 12 (4) of the ICCPR no one shall be arbitrary deprived of movement but it is derogable in a state of emergency.
