"Dismissal without real and serious cause": a French employee wins her standoff against Tesla

Sophie, a product specialist at Tesla France, was dismissed for economic reasons in 2020. A decision considered abusive by the industrial tribunal in 2022. The Versailles Court of Appeal has just confirmed and ordered Tesla to pay her more than 100,000 euros. (=$103,100)

See? that's what happens when a country's Judicial system is here to protect the workers.

Supposedly Tesla is sued multiple times daily and I would really love to see the scorecard on how these are turning out

Fucking France with their Freedom. I wonder what that's like. I wouldn't know. I'm American.

And this dick wants to delete the CFPB here in the states.

1 year ago | Likes 1 Dislikes 0

Let me know when she collects the debt.

1 year ago | Likes 3 Dislikes 0

No, that's what happens when people know workers will do something.

I feel like a $100,000 fine means he can just do it again...

When he took over Twitter he started deeming people to have resigned for not ticking a 'yes' box within 24 hours in an email he sent to the execs in Ireland. That backfired too. Took about a year and a half to get a ruling. https://www.irishtimes.com/business/work/2024/08/13/twitter-ordered-to-pay-550000-to-executive-who-failed-to-respond-to-elon-musk-e-mail/

France has some good protections for workers. A friend works at a company with an office there, the company had to pay a lot to close it.

Ol' Musky will soon be tweeting how CONCERNING the state of race relations in France is, and giving money to the most reich wing lunatics in politics he can find.

1 year ago | Likes 52 Dislikes 0

Problem is that the most right wing lunatic in France, and that's not even Marine le Pen, has called for a ban on electric cars..

1 year ago | Likes 8 Dislikes 0

France has great workers rights protection. Also their unions will burn the country down before they let anyone mess with them.

1 year ago | Likes 102 Dislikes 1

As it should be.

1 year ago | Likes 22 Dislikes 0

It's not all pink though. Some, not all, union leaders can also be power hungry characters that don't necessarily have the worker's best interests in mind.

1 year ago | Likes 10 Dislikes 2

Problem in the US. Much less so in France.

1 year ago | Likes 1 Dislikes 0

Unionism in the US was always hampered by its close ties with organised crime - some unions were little more than rackets

1 year ago | Likes 3 Dislikes 0

that's not exclusive to France though.

1 year ago | Likes 2 Dislikes 0

Power corrupts, you say? Lol - yeah, I get it. The solution is always radical transparency & democracy & freedom of speech.

But not "£re€dom of $peech" as held by "Citizens United" decision.

Saudi Arabia is a mostly horrible country, but our labor laws do heavily favor workers over employers. And they are strictly enforced.

Only on paper though.

Unless they’re migrant workers building the new World Cup stadiums who are virtually slaves. 6500 died preparing for the Kuwait World Cup, who knows how many will die in SA. Call me old fashioned but major sports events shouldn’t have a death toll

1 year ago | Likes 4 Dislikes 0

Kuwait isn't KSA. That said, workers from western countries tend to fare well. I can't vouch for the safety of migrant workers from random locations, but I do know that they are well-compensated. I got to know one Sri Lankan guy who had been a lawyer in Sri Lanka but earned more than 4x as much as an office boy in KSA.

I'm sure Sophie would've liked getting compensation for unlawful termination without struggling through 5 years of litigation.

*And then losing.

1 year ago | Likes 1 Dislikes 0

What? That just doesn't make any sense. That money belongs to the shareholders!

I mean, legal expenses of the winner is normally covered by the losing part in such suits (in Norway, at least)

1 year ago | Likes 1 Dislikes 0

that's why we have punitive damages. fun fact, texas limits punitive damages to $750k, regardless of the crime in question, but DOES NOT tell the juries that. (they found that juries tended to find exactly 750k in punitive damages and lumps the rest into actual [i.e., recoverable] damages)

1 year ago | Likes 86 Dislikes 1

Could your lawyer, in court, inform the jury of that?

1 year ago | Likes 14 Dislikes 0

That's a part of tort reform and is absolute bullshit its the same thing that prevents you from suing for an amount of money that would be required to support you for the rest of your life after someone's (read a corporation) actions leave you barely alive and needing lifetime care. Juries will award 25-30M, and the judge comes in and has to pencil in 2M as it is the maximum the law allows. And 2m runs out fast when you are injured in your early 20's and need lifetime assistance.

Greg Abbott after his injury which made him rich through suit and he got elected to Texas fuhrer, he passed legislation to ensure no one else could ever sue for as much money as he did. Can't make shit like this up XD conservatives pulling the 🪜 up behind themselves like always.

Sure, but that's apparently what it takes when you're first-mover against Tesla :-(
Hope, this will help others, so they don't have to endure the same.

Big corpo will often drag a case out, spending 10x, 100x or more what a payout could be to make sure the little guy doesn't win.

1 year ago | Likes 16 Dislikes 0

Yup, 'cos if one little guy wins, they all can. So, it is often a good investment for them to squash down the little guy like that :-/

Tesla has problems hiring German staff here in Germany, as they have a terrible reputation, poor compensation compared to BMW, VW (that’s another issue), etc. I spoke with a guy who works at the local gigafactory, he is from the states, and he was thrilled to work here stating he got 25days vacation, health insurance etc. I told him that these things are the bare minimum by law.

But Elon belongs to the GSDP German Social Democratic ( They are none of these, they are fucking NAZIs ) Party.

1 year ago | Likes 1 Dislikes 0

Slide him an application for BMW or VW.

Christ, Tesla is so bad they have to H1B americans out of the states xD

1 year ago | Likes 78 Dislikes 0

Isn’t VW doing a big downsizing?

1 year ago | Likes 2 Dislikes 0

Yes, they are, all car sales have declined and the expected uptake on EVs has not happened.

1 year ago | Likes 1 Dislikes 0

I was an intern with them after college and it was amazing the way you treated as an intern compared to being expected to do it for free in the U.S.

1 year ago | Likes 2 Dislikes 0

Damn, have to brush up on my German and go over there. Maybe meet a nice woman

1 year ago | Likes 5 Dislikes 0

Haha, I love when Americans discover how things can be better outside the US... "but I thought US was best country in the world!"

1 year ago | Likes 38 Dislikes 4

I'm American and can say I know it's not. Failing on s many levels.

1 year ago | Likes 1 Dislikes 0

Literally nobody really believes that. It's a running gag.

1 year ago | Likes 10 Dislikes 0

A lot of Americans know it, it's just almost impossible to leave without wealth and/or family ties to another country

1 year ago | Likes 21 Dislikes 0

Fuckin trapped :/ couldn't even move states if I wanted. Though thank God I don't. I live in CA. Pricy but safe for someone like me.
