However, the whale is technically a "self-propelled vessel," and the windsurfer could be a classed as a sailboat, therefore giving RoW to the windsurfer.
I actually checked: Rule is who has the most maneuverability. Technically the sailboat has more than the whale in terms of tonnage and turn radius. Therefore whale has right of way.
