As far as I understand, DOGE is set up as an advisory body to the president. The president can therefore assign government officials to assist it administratively whilst the actual "advisors", i.e. Musk and his cronies, would not be employed by the government.

Musk wealth: 378 billion. US GPD (that's the money it makes in one year): 27 trillion. Musk is still one order of magnitude short... technically far more because most of his wealth is on paper and he doesn't make 378 billion a year, but let's not worry about that. Technically speaking, there’s nothing illegal about private armies. The US has constitutional rights to form organised militias, and is not internationally party to either of the mercenary convention acts. It’s why companies like Blackwater can exist and operate with impunity alongside American forces.

That isn’t to say it’s a good or bad thing, just that there are literally no legal restrictions to doing that in America, for Elon or anyone else.
