If that worked every prisoner could just have someone choke them out until their heart stopped and then bring them back. Boom. Sentence over

In some US states that could fly where if the person dies they have the option of voiding their marriage contract

Go full monkey's paw and bury him alive.

I love it!

Depends on what state. If this was Texas, they'd have to give him a horse, a pigsty with six bullets, and $12 then let him go.
...pistol, dammit.

Man, I posted that gif to a post about that article like earlier tonight. Should be one of my last comment.
I give you half my internet points

1/2Back when they used to hang people they actually had to change the law to “hung bu the neck until dead” because at one point people would
2/2 pass out or the rope would break so they were just set free because that used to mean the hanging was complete
GrizzlyBearCrossing
In Scotland the rule was if you survived three hangings they would set you free. One guy bribed guards to have the rope shortened by a foot.
I was on an Edinburgh tour when I heard this. I just tried to look it up and couldn't find it. Might be bullshit
INYOFACE1
It's true, i believe. They believed that if you had survived 3 seperate attempts at hanging it had to be a sign from god that you weren't /1
meant to die, and thus would be set free under gods will.
Iwasoutedbyatroll
i think the standed, set over two thousand years ago, is you have to be dead for three days and then come back for it to count.

And for it not to be a myth

Never forget, Jesus gave up a 3-day weekend for your sins.

I don't think precedents set in the Middle East really count for American law.

I don’t believe in Jesus or anything but...almost? 2019>2000, right?

1AD is to mark the birth of Jesus and he was supposedly in his 30s when he died so it would be almost until 2030 something

What this post leaves out is that he had filed DNR orders. They ignored that and resuscitated him. His sentence should be over.
Camelspotting
His sentence is over when he has served his time.
ImDavidPumpkins
As far as loopholes go, this one seems pretty legit
N0ticeablyFAT
I don't actually know the legality of it, but I suspect DNR is one of the things you lose in prison. They incarcerated you and are...
...responsible for your health, regardless of your opinion.
Wearegrid2
Everyone is missing the obvious solution here: take him out back and manually aerate his skull with a .40 caliber broomstick.
D0MiN8R
We could be friends.
I mean, he is supposed to be dead and free, we can do both.
Allobarrister
Holy shit that actually does change this from an attempt to exploit a semantic loophole to a legitimate claim for an appeal.
MoraMultus
If i remember from the last post DNR orders can only be accepted from certain medical professionals. Like only a doctor can pronounce time/1
Of death. The people that resuscitated him legally had to/2
Rifneno
I don't think a killer should be freed because of it, but I do think whoever violated it needs to go to prison too.
Aquilarden
They didn't break the law, though.
DrDoALittleMoreThanBareMinimum
I think the thought process is that if the dnr was respected he would have died and his sentence would be finished but now he has to suffer
Ehhhh. Depends on if he's still a danger to society. If it was a one-off crime of passion, consider it. If he's just a psycho, well...
Yeah I mean variables are there, I'm not familiar with the case bit I believe he beat a person to death. Dnrs should be respected tho imo
BigBadBillyBoy
They took him from the prison to a nearby hospital for the event. ER doctors resuscitate when there’s any doubt about the paperwork.
MaladaptedMedic
True, but DNR that paperwork should've gone to the hospital with him (or been on file there)
In the case of one of my family members, the doctors specifically refused to accept a DNR because it was more than 30 days old and 1/2
not on their form. The risk of fucking that up is so great they won’t accept any doubt at all. 2/2
Chainhealer
His sentence ends when he is legally dead. He never was and isn't. Death is irreversible. The people that ignored his DNR suck, but legally
According to some canadian (i think), no. He's "officially" dead (cert. and everything) but turns out he was misdiagnosed in a coma and /1
woke up later or something like that, and because he has a death cert. his country refuses to acknowledge he's alive.
it doesn't change anything for his sentence.
darkstarmc
You should go read up on brain ex and reviving dead or brains. Dead is dead at current tech levels.
END3RW1GGIN
It's not just a "they suck". In the civilian population if a hospital were to do this people could go to jail. DNR is a legal document.
MrE158
Right, but that just means whoever ignored it should be punished. Being the victim of something doesn't absolve someone of their own crime.
Ignoring a DNR is legal.
In certain circumstances, yes. In this one most likely they should have followed it.
