Hoping they hold IG folks videoing themselves to this standard. Unless you have their permission, aim your camera to ensure you’re not videoing or photographing other people.

it's a mixed bag. as a power lifter moving weights most people here will never touch filming yourself can be immensely helpful for personal progression and form checks. i honestly believe most people filming are doing so in good faith. doesn't change the fact there are enough jerks ruining it for everyone. i also keep a lifting log on my phone so it's super handy during workouts. between logging sets and music i most definitely will not leave my phone at home or in the locker.

In public places, recording is ok and even encouraged as far as you don't enroach on someone else's rights (right to privacy doesn't exist in public area, but some restrictions do apply). The second you step into non public space, that right is gone. You need permission of EVERYONE in that space to take pictures or to record. Or you're liable...

This is why I go at 5am. Everyone else there is just trying to do their workout, same as me. It helps that the gym is always playing copyrighted music *just* loud enough to get picked up by your microphone. The bossman says it's so you can Shazam it, but quietly says the IG hoes can't use whatever they try to record.

Twice now I've reported to gym staff of people setting up cameras on tripods and taking photos of themselves in the mirror in the locker room, when there's other people behind them in the background, one guy was using his phone on a tripod and the other was using a professional photo camera with a big lens and everything. My stance is that I do not want to be in your photos so do not take any if I'm in the room.

You may not like it but there is no expectation of privacy in public. That said, this is a private business and can set their policy as they wish. The business can film you if there is sufficient notice (contract, signage) or cameras are in plain view; you can choose not to be filmed by not patronizing the business. Being able to record in public is a first amendment protection. Private business policy is not law but if you are asked to leave and do not you risk a trespass charge.

There's nothing to pay off? You pay monthly fees to them. It's a huge pita to cancel though. I had to physically go into one of their gyms to get mine canceled years ago. It was either that or mail something in I think and then wait... The freeze option is just as bad too. You have to pay about $10/month to freeze your subscription, and you don't have access to use the gym while it's frozen. Fuck that gym man.

I have such a bad perception of that gym, when i moved a few years back i checked out the local LA fitness and the sales guy was supper aggressive. My wife (then fiancée) and i were getting a membership together and i told the dude i had to go talk with her about signing up, he went on this whole thing about 'you have to ask her permission to do everything?'. HARD no from me lol

I had a membership for years. Tried to cancel it and they said to try pausing it instead. Did that for about a year until I realized I was still paying like $10 a month to not be able to use their facilities... Canceling was a huge pita. Had to physically go in and not let them convince me to keep my membership...

And... no. Filming in a publicly accessible area is protected by the first amendment. Although this is a private buisness, it is open to the public. In public, you have no reasonable expectation of privacy. They can ask you to leave, revoke your membership, but there is no legal recourse except a trespass if they refuse to leave.

A private business that's open to the public can prohibit any photography/filming, but it's still a policy that won't be enforced by the cops. If it's in a membership agreement they could sue you for breach of contract, though the damages are likely to be minimal.

It's not exactly "open to the public" though if they require a membership to get in. You would have to make the argument about if the particular space offered a "reasonable expectation of privacy" or not. They got the guys that did undercover filming of Planned Parenthood leaders talking about kickbacks on wiretapping charges even though it was recorded in a public restaurant.

I think you're grossly over simplifying "open to the public" Anybody can apply for a gym membership to gain access. It's not really about access control but collecting payment. I disagree, in public you should have NO expectative of privacy, and if you can see it you should be allowed to record it. In the gym case, its a closed private property, so not in public. But if it has windows that can allow anyone from outside to see (from a public location) then back to the start we go

My state is two party consent for recording. Cops tried to bust some kids for filming them beating a kid. Courts ruled as a public employee you automatically consent.

Cops are an exception to this. Police have the legal ability to arrest, physically restrain, use force (up to and including lethal force), forcibly enter private property, search and seize assets. While on duty and taking official actions there is not a reasonable expectation of privacy - transparency is absolutely necessary for any counterbalance to exist against coercive force.

That is the rule in private establishments, at least where I live. When you're in public though, there is no right to privacy. Public sidewalks and public streets are free to be filmed without permission, and if you don't like it you can leave the area.

No you don't. You literally don't have the right because you're in PUBLIC. That's the literal distinction we're making here. In private, you have more broad rights than in public. At least in my country that's true. Dashcams, traffic cams, news reporters, surveillance cameras, families on vacation, toktokers, etc. are all allowed to record whatever they want in public.

it is ... in Germany ... by law ... taking pictures of people without their consent is not allowed ... if you publish them then this is a punishable offense resulting in financial penalty or prison up to 1 year ... that's why Google street view is totally crippled in Germany

There's a similar thing in France, basically rights to your image. You need written consent to record/publish pictures of someone with obvious exceptions such as public figures while they work (politicians or celebrities), historical or newsworthy event as well as crowds so long as you're not the focus.

From the perspective of a truck driver, street view is a godsend, cause a lot of the times the address and the truck entrance don't quite line up. Plus, you can see if the turn is easier from one direction VS another, or if you'll need to take multiple lanes to clear the landscaping, etc. Satellite view does a fair job, but street view is just lightyears ahead. Too bad there isn't a simple middle ground solution atm.
