Been dealing with news that taxes were never paid on the house we live in. Was told we have until mid August to pay, or they will sell in September. Got a letter today that if we dont pay to the estate we will be evicted. Got 2 weeks for that.

I feel like im drowning. We have 3 adults, a kiddo thats 6, and 2 dogs, plus 5 ducks we added this year. A house that not just my husband but his mother grew up in that we will lose. We have no money saved up and no way to fully afford to just up and move, but we have no choice.

I am so overwhelmed, but I have to be the backbone of the family because if I dont it all crumbles, and we have to do this for the sake of my kid.

Idk why im writing this. Maybe to just scream into the void that is imgur. Ive done it many times and it helps. I guess I also want to hear from others, because its the only real connection to other people that I have. Yall are so supportive and caring and I could really use an internet hug today.

You need to consult a professional lawyer. My aunt lost her house by just giving up it was too much. You have options don't just roll over. :(

Why not just take a partial mortgage out on the house? Use it to pay the taxes, and do any necessary repairs

Im not sure, from what the lawyer said we'd have to pay them off their portion. The house was valued at around 90K I think a few years ago (even though its falling apart, literally) and for aome reason the number around 50K is sticking in my head so maybe that? Waaaay more than Ill ever see in my lifetime.

If you don't have anywhere to go... squatting might be a viable move for you. I've read all kinds of stories about it taking months to get squatters out of houses.

Silver linings. 1) A perfect time to streamline and simply what you have and prioritize, even if under stressful and unplanned circumstances. 2) with nowhere to go you can go anywhere. There are few times in life where change (no matter how stressful) can be unfettered. Use that freedom however you can.

For an eviction, please please please look up the laws in your state/country. At least where I live, you have 30 days from WHEN YOU WERE SERVED the eviction notice to get out. That’s the minimum here. A letter telling you they intend to give you an eviction notice is not an eviction notice in and of itself. Please look for your rights, y’all, you deserve them.

All in the so-called ‘richest country in the world”, all because the richest 1/10 of 1% need to have more money than god himself.

As somebody who has spemt a good deal of time researching tax liens. In most cases you can talk to the state, or usually the county treasurer and start a payment plan. Idk who told u if was hopeless but be careful there are some shifty people out there, that will skim the tax auction lists and send letters or call ppl and try to scare them into selling way below market value. Tomorrow, call the county treasurer’s office and find out exactly what the deal is, then contact a lawyer.

If u can start a payment plan, set that up. If you have to have full value, go talk to a bank or local credit union. They should be able to help. Not all is lost. Most states make sales/auctions for unpaid taxes favor the owners over the buyers. A lot of states you can even pay the auction winner back their money + some interest to take back possession of the deed.

Whats got me feeling hopeless is if the state doesnt take it for taxes, they will for probate because the other kids in line are forcing things and dont want my husbands mom here so wont settle.

Make sure you get some legal advice from somewhere. Don't just take what you've been told unless you have it corroborated by someone on your side. I am not a lawyer, nor in the same country. So I don't know what rights you have. But good luck, whatever happens.

If you're renting, some sales can go through with sitting tenants, for example (depending on type of contract).

Without knowing the full story. You say "estate". If the house is willed to you, you should be able to get a mortgage very very easily. Unless there is a mortgage already on it. Even then, if the value of the house is enough, you should still be able to refinance. Including the taxes. I'm not sure where you live but, here in my county in NY, you can be 3 years behind and get a payment plan.

From OP's comments, owner died 4 years ago. Ownership of the house is contested but OP lives in the house knowing about the estate issues. OP wants the house, but family wants to sell for cash. No one paying property taxes. OP can't afford to pay tax. OP can't qualify for a mortgage. OP has been living for free in the house? The estate has offered to allow OP to stay if they pay rent. OP is saying that they will be homeless, but if they start paying rent on the house they won't be homeless.

The house never got put into a will, and the other descendants hate my husbands mom (granted, they have good reason to, but thats beside the point). They're the ones forcing the probate period, which I mean we knew was coming.

That is unfortunate. I am sorry you are going through this. Don't be afraid to call the treasures office or whatever department collects property taxes. Hopefully you can at least keep the house and possibly buy out the other family members.

She says in the gofundme that the house belonged to the husband's grandparent who died intestate. Apparently that estate never went through probate, so the mom didn't own it either, it belongs to the grandparent's estate still. Now the other heirs want them to process the asset, and unless there are enough other assets to fairly offset the value of the house, they have to sell the house. Someone else said the estate has offered for them to pay rent and continue living there.>

This seems unfortunate but it doesn't sound to me like it's unfair to OP's family, although there could be other factors, like the other heirs are way more wealthy, or have already taken assets from the estate.

I didnt see these comments before, sorry for missing them! So the other family membera are very well off. The one is a child of one sibling that has already passed and has money from her mom passing, and the other has a new house in another state, with lots of extra money to go to the casino every weekend. They only want the house because the siblings never got along with my husbands mom growing up (they were half siblings, with my MIL being the only bio child of both grandparents)

It's a little hinky because it sounds too like she's saying they are in the position of needing to *close* probate, which would mean the husband is the trustee, and it seems like that would be contested under the circumstances too.

I don't know OPs area, but I know I was unable to get a mortgage until I had paid all outstanding debts. Additionally, most banks won't issue a mortgage if there is a lien on the property.

If the value of the house is more than the liens, and all other debt, a mortgage is a breeze.

@op DO NOT GO ANYWHERE. Who owns the house? If it’s your husband then you should be able to get some kind of equity loan against the house. Do not go anywhere until you’ve talked to a lawyer

Ive been answering a lot above in other comments. Technically the house belongs to the state as there was no will when the owner died. We had a lawyer but neither him nor the other fams lawyer want to try and prove the other kids were adopted, and they are pushing us iut so they can sell the estate and get money from it. (even though theyre all v well off with money and brand new houses) its all for spite.

Nobody. The owner passed away 4 years ago and didnt have a will, so we have to deal with probate on the property. My husbands family wants us out and want the estate money, which is what their lawyer is pushing for. They sent a letter demanding we pay rent to the estate or they will file an eviction for 2 weeks from now

Who has been receiving rent money for the past 4 years? Or have you not paid rent for four years? You said that you can't afford to pay the back taxes and don't qualify for a mortgage, but what is the issue with paying rent? This comes across as if you have been paying nothing and living for free for 4 years in a house that you don't own.

My husband and I have been paying his mom monthly, and she has kept up with the mortgage payments and property taxes until last year, when my MIL stopped paying taxes fully, which we had no idea of until last week when we got the notice.

Be angry at your MIL; she got you in this situation. The other family members might actually be the reasonable rational ones. You can't afford to buy the house but the estate is offering to let you stay if you pay rent. The fact that this has dragged on for 4 years means that they aren't in a rush to kick you out. That only became an issue because your MIL stopped paying property tax and mortgage. If the estate is offering to let you rent, then rent from the estate so you can stay.

Oh I am. And the worst part is the family is being spiteful because MIL wouldnt let them come take some mementos of gramps when he passed. Like I would let them in a heartbeat because rhw stuffs sitting in a cabinet collecting dust! She doesnt care, she never looks at it. Its all bc they hate each other and are acting like kids and not the 60 somethings they are.

If she’s been paying mortgage and taxes up until recently then she has a VERY VERY good claim on ownership. Hire a lawyer. Set up a go fund me to hire a lawyer. I’m sure there’s a lawyer nearby that will help you out of compassion to start. Contact the Eagle Team, even if they’re not in your area they will help you find the right kind of lawyer
