I go to conventions all the time, artist are always selling fan art. I doubt all of them got some sort of permission.

I don't think the commercial copy right laws apply in these personal fine art pieces, unless they start using the image in posters and such.

There are some buildings you cant photograph and sell, also pictures of eiffel tower at night are technically illegal, because of the lights

Imitation is a form of flattery. If you make money from copying my art though, it sounds like counterfeiting. I see what you mean but 1/2
