The teacher was found guilty of having sex with one of her students, who was 16 at the time.

She is serving a "sentence" of 180 days.

The teacher is now suing the student she had sex with because the student defamed her "to various classmates, family and other members".

The suit's purpose is to financially protect her from the charges related to the case.

She, along with the school district that employed her, is currently being sued herself by the family of the student.

To be honest, I have to wonder what the sentence would be if the teacher were male and the student were female.

But...there ya go.

Any teacher who has sex with their student is a horrible person. It's a gross abuse of power and it disregards their education and health.

8 years ago | Likes 11 Dislikes 1

My male teacher had sec with a 16 yo girl and didn't do any jail time. Just got his license taken and had to register as an offender

8 years ago | Likes 6 Dislikes 0

He "defamed" her with "statements"? They went easy on the details there.

8 years ago | Likes 6 Dislikes 0

It'd be nice to know more. But that's not how imgur operates when it comes to most things.

8 years ago | Likes 1 Dislikes 0

She's lucky she only got 180 day, So arrogant to sue on top of this.

8 years ago | Likes 9 Dislikes 1

It's only defamation if it's not true, she's been convicted so it's clear that it was true

8 years ago | Likes 5 Dislikes 2

We don't know what statements she's suing him for. Probably something else besides "I had sex with teacher."

Where within that article did you see the countering of a double-standard?

8 years ago | Likes 1 Dislikes 2

Did you read it? Executive summary: when you compare apples with apples, men and women get the same sentences.

8 years ago | Likes 4 Dislikes 0

Same thing in custody situations. The MRA types are delusional.

8 years ago | Likes 3 Dislikes 1

"Statements made by the young man hurt her reputation and her career." I don't suppose having SEX with a MINOR is more to blame for that..?

8 years ago | Likes 56 Dislikes 3

That's an argument to mitigate damages. Doesn't tell us much about the defamation claim.

8 years ago | Likes 2 Dislikes 0

If it was all unsubstantiated lies, sure, defamation— open and shut. I hate lawyers that push shit like this forward.

8 years ago | Likes 18 Dislikes 1

Yes, her lawyer's got some explaining to do.

8 years ago | Likes 1 Dislikes 0

A lawyer has no explaining to do, it is the lawyers job to protect their client. She however, is a piece of shit if everything is true.

8 years ago | Likes 1 Dislikes 0

I wonder her angle on this. Like, is she going to go for specific sex acts that he bragged about that didn't happen? How's there a case?

8 years ago | Likes 11 Dislikes 0

Did she really think he wouldn't brag to mates? Teenage boys are not known for their ability to keep a secret.

Age of consent in California is 18. No idea why anyone thinks it's 16.

8 years ago | Likes 7 Dislikes 0

Some states have "romeo and juliet" laws that may allow a 16 year old to have sex with someone who is like 18. Probably still wouldn't apply

8 years ago | Likes 4 Dislikes 0

Pretty sure California has that, but it definitely wouldn't apply here. Age difference is too large, and she's in a role of authority.

8 years ago | Likes 4 Dislikes 0

Fun fact: it is not legally possible to defame someone by telling the truth.

8 years ago | Likes 145 Dislikes 1

Yet you'd be crucified for calling a fat person fat.

8 years ago | Likes 2 Dislikes 1

Which is why I'm wondering if the claims are based on other statements that we don't know about here.

8 years ago | Likes 1 Dislikes 0

Fun fact: you can spend the rest of your life without taking a breath.

8 years ago | Likes 12 Dislikes 1

Maybe he said she had an ugly vagina

8 years ago | Likes 57 Dislikes 1

Luckily, opinions aren't subject to libel laws. I think. IANAL. (However: If I said the teacher does, too, and she doesn't, THAT is libel)

8 years ago | Likes 4 Dislikes 0

But maybe thats the truth

8 years ago | Likes 39 Dislikes 0

He would know.

8 years ago | Likes 9 Dislikes 1

Unless you can't provide evidence that what you said was true. A guilty sentence counts as evidence, though.

8 years ago | Likes 15 Dislikes 3

And the guilty verdict is probably irrelevant to whatever comments she's suing him for.

8 years ago | Likes 1 Dislikes 0

Yea as the Plaintiff it's on her to prove her claims, not on the defendant to disprove them.

8 years ago | Likes 2 Dislikes 0

In the US, they have to prove that what you said was false and usually that you knew what you said was false.

8 years ago | Likes 10 Dislikes 0

Serious question in what case can defamation even be proved

8 years ago | Likes 1 Dislikes 0

Plenty of cases, what do you mean?

8 years ago | Likes 1 Dislikes 0

I dont know i just always thought of it has he said she said

8 years ago | Likes 1 Dislikes 0

You see it in the business context a lot. So usually a written publication, or a customer can testify that the defendant said "blah."

8 years ago | Likes 1 Dislikes 0

It's not defamation if it's a private comment. Has to be public, so there will always be witnesses/documents.

8 years ago | Likes 1 Dislikes 0

On the low sentence, the student may have testified that they wanted to. Remember, minors aren't allowed to have sex with adults willingly

8 years ago | Likes 4 Dislikes 1

This can depend where you live. My country age of consent is 16, but there's separate laws that criminialize it when one party is in a

8 years ago | Likes 4 Dislikes 0

position of authority over the other, like teachers.

8 years ago | Likes 6 Dislikes 0

Age of consent at 16 or Romeo and Juliet laws at 16? But yeah.

8 years ago | Likes 1 Dislikes 0

Those exist too, but apply if the person is 14 and 15 (5 year difference). No one under 14 can consent. 16 is general age of consent.

8 years ago | Likes 2 Dislikes 0

Yeah let's see what sentence male 36 year old would get for fucking a 16 year old girl.

8 years ago | Likes 29 Dislikes 14

You're not comparing this case where you don't know if the student was willing with full on confirmed rape are you? Or molestation?

8 years ago | Likes 8 Dislikes 19

Your psychological projection is showing.

8 years ago | Likes 2 Dislikes 1

My point is unless you've actually accounted for that it's easy fake outrage. And fake outrage is depressingly common.

8 years ago | Likes 2 Dislikes 2

My step dad had sex with a 17 year old girl at around that age. 5 years in prison, still on probation.

8 years ago | Likes 5 Dislikes 1

And depending on the state that nay still have been the legal age of consent.

8 years ago | Likes 1 Dislikes 0

ew. Sorry to hear that

8 years ago | Likes 1 Dislikes 0

He said 36, not 30! /s

8 years ago | Likes 6 Dislikes 1

So....16x what she got.

8 years ago | Likes 3 Dislikes 4

I see nothing in her case about registering as a sex offender.

8 years ago | Likes 3 Dislikes 2

Right, so the guy gets 4 years parole and sex offender...she gets 180 days served, MAYBE. We'll see if she even serves the whole thing.Fair?

8 years ago | Likes 3 Dislikes 3

She got half a year in jail. He got no jail time.

8 years ago | Likes 3 Dislikes 1

And he has a lifetime on the sex offender list, she doesn't. He has 4 years probation, she doesn't. All unequal. They both should be in

8 years ago | Likes 1 Dislikes 1

2. prison and on the sex offender registry.

8 years ago | Likes 1 Dislikes 1

Half a year in jail that may or may not be served, vs 4 years probation and a lifetime on a sex offender registry. Which hurts more?

8 years ago | Likes 1 Dislikes 3

She's literally in jail right now. It says that in the OP. And she also got 4 years probation, which is also in the OP. Are you blind?

8 years ago | Likes 1 Dislikes 0

I love the wording, Since it's a female, its magically not pedophilia and statutory rape.

8 years ago | Likes 453 Dislikes 32

Men's rights activists (MRAs) are those who spread this message, among others.

8 years ago | Likes 13 Dislikes 27

I know in some states (Michigan) 16 is the age of consent so long as you're not an authority figure. Some states may lack the latter clause.

8 years ago | Likes 8 Dislikes 0

I'm a female teacher. This is absolutely statutory rape, and she needs major jail time.

8 years ago | Likes 14 Dislikes 1

All rape is statutory

8 years ago | Likes 5 Dislikes 2

But not all rape is only statutory.

8 years ago | Likes 2 Dislikes 0

"Pedophilia" is not illegal, as it's just being attracted to children. Actually having sex with a child is "statutory rape" which is illegal

8 years ago | Likes 23 Dislikes 2

So pedophilia is super creepy, and morally horrible, but if you never act on it, it's not illegal.

8 years ago | Likes 24 Dislikes 3

People having sex with 16 year olds isn't pedophilia. It's the normal age of consent almost everywhere on earth; but not California.

8 years ago | Likes 2 Dislikes 1

It's not pedophilia because the victim was 16.

8 years ago | Likes 48 Dislikes 2

It's phrased as "sex with student" in countless news articles about male teachers doing the same thing. Go ahead, look it up.
