The guy got pissed on and he doesn't even hit the dog. And most post I find of this only use frames from the gif that make it look like he hit the dog.

Usually the shirt comes off before the fight. Unless you're pissed on.

There's also another post where this guy felt bad about his actions & actually finds the dog & takes him in as a pet. That's being ignored

well, he was trying to kick a dog.If you attempt a crime,rape,bank robbery,and you don't succeed, you still get treated as if you succeeded.

Dogs aren't people. If someone with the intelligence (and, here at least, physique) of a two year old pissed on you, would you punch them?

The queston is, did this dog realize it's a human, not just some weirdly parfumed sack of fabric that smells unmarked? We can't ask the dog.

So we can't assume that the dog knew what he did was wrong. I don't even know if dogs even mark living things, or just inanimate objects.
